The Highways Agency employs a company called Enterprise Mouchel to undertake maintenance work on the A30 in this area. Enterprise Mouchel has asked St Erth Parish Council to draw to the attention of residents, the problems of vegetation encroaching on to the A30 and/or adjacent footpath/cycleway from private property.
The Highways Agency has the power, under Section 154 of the Highways Act 1980, to require the owner of any tree or shrub which is obstructing the passage of pedestrians or vehicles along the highway or causing a danger to anyone using the highway, to cut it back so as to remove the danger or obstruction.
If such a requirement is not met within 14 days, Enterprise Mouchel may carry out the work and charge the owner accordingly.
Enterprise Mouchel go on to say that it would be preferable if such orders were not required and are therefore asking the residents concerned to cut back any overhanging, damaged or diseased vegetation.
